In accordance with Section 5 of NOM 247 in case of an accepted offer, and if the Client requests a Due Diligence Period, the latter will have the right to request Ciccone D Ambrosio Realty Group S. de R.L. de C.V.  (dba Casa Nostra Realty), the information contained in that same section including among others – (i) Information of Company creation, (ii) Contact Information, (iii) Address, phone and email, (iv) letter confirming the right to list the property and or the right to contact the listing Broker to commercialize the Property, as well (v) as Property title, (vi) information of any liens if any, (vii) financing conditions if available (viii) Construction permits, manifestation and other relevant documents including if Available by Seller of Plans, and other specifications including any type of warranty if available.

 

In addition, all marketing materials are not intended to induce a Purchaser to an error or mistake in extraordinary Conditions of the Property. Therefore, the Clients have the right to confirm all information in a visit to the Property.

 

The agreements to be used to enter into a valid offer are or will be registered at the Mexican Consumer Agency (Procuraduria Federal del Consumidor) PROFECO.  The Agreements Registration Number will be provided to Client upon request In case of any complaint you can contact  https://www.gob.mx/profeco

Privacy Notice

 

Ciccone D Ambrosio Realty Group S. de R.L. de C.V.  (dba Casa Nostra Realty), hereinafter the “Responsible Party“, with address at Bahia De Palmas L 1 Y 3 Sn, Plaza Del Mar Y Bahia De, Campo De Golf CP. 23405, San José del Cabo, Los Cabos, Baja California Sur, Mexico, is responsible for collecting personal information on the customer or user of the products or services, hereinafter the “Holder“, as well as the use that is given to the same and protecting it.

 

Personal INFORMATION.

 

The personal data that the Responsible Party may collect including names, last names, domicile,  equity aspects, phone number, e-mails, federal tax number, payment forms, social security numbers, and tax identification, and  in general all the information that the Holder provides at the moment and/or as long as the commercial or contractual relationship subsist, including without limiting any other data that the Responsible Party collects from time to time related with the relationship entered into by and between the parties; under the law command, under the command of the authorized authority or thru any other source allowed by the law. All the personal data to identify the Holder, granted by the Holder or any other contact source such as contact and/or chat room, public registry of property and commerce or any other governmental institution whereby the Holder data can be consulted, can be collected by the Responsible Party.

Data collection performed by the Responsible Party, is in good faith and is therefore presumed that the data are true, correct, complete, and identify the Holder that provides self is the responsibility of the Holder that the data it provides to the Responsible Party comply with such features and may be updated as required. Likewise, the Responsible Party reserves the right to take the actions it deems appropriate in case false data.

 

PURPOSE OF PERSONAL INFORMATION

 

The personal information requested in the corresponding application or whatever other document or physical or electronic means, related to the service or product that the Holder wishes to contract with the Responsible Party, may be sensitive to their equity aspects or financial aspects, which shall be used to provide services and products that have been required, such as:

 

  1. a) Order, purchase, exchange, or return products, offered by the Responsible Party, whether provided by the company or through third parties;

 

  1. b) Request, hiring, change or cancel services, offered by the Responsible Party, whether provided by the company or through third parties;

 

  1. c) Make payments online; in order to make charges to the bank or to credit and/or debit cards, fort the products and services hired by the Holder;

 

  1. d) Order digital tax invoice or voucher;

 

  1. e) To request a quote, information or free samples of products and services;

 

  1. f) To request home delivery, warranty repair or performance of products or services;

 

  1. g) To create personal profiles;

 

  1. h) Use the various services of their respective Web sites including downloading of content and formats;

 

  1. i) Where applicable, verify credit worthiness and / or payment of the Contractor, which shall be conducted through the credit information companies, in terms of the Act to regulate the Credit Information Companies;

 

  1. j) Check the trade by the Holder with the Responsible Party;

 

  1. k) Process payments in order to make charges to bank credit or debit cards, for products and services hired by the Holder; and

 

  1. l) Any other activity of a similar nature to those described in items previously mentioned.

 

 Also, the Responsible Party, directly or its contracted third parties can use the Holder’s personal information for the purpose of:

 

Where applicable, verify creditworthiness and / or payment of the Contractor, which shall be conducted through the credit information companies, in terms of the Act to regulate the Credit Information Companies;

Check the trade by the Holder with the Responsible Party.

In the case of applicants for Responsible Party employees, will be carried out the following activities:

 

To conduct research for the process of recruitment and personnel selection;

To carry out the hiring process;

To perform all aspects related with tax obligations and/or the compliance of any obligation under the contractual relationship with any municipal, state or federal authority;

The Responsible Party is herein authorized to share Holder’s personal information with any service providers and management database management, recruitment, legal services, audit services, and other companies or third parties that provides services of a similar nature to those described.

 

USE OF THE RIGHTS OF ACCESS, RECTIFICATION, CANCELLATION AND OPPOSITION OF THE HOLDERS

 

At all times the “Holder” shall be entitled to access, rectify and cancel his/her personal information, as well as to oppose treatment of the same or revoke consent that he/she has granted to the Responsible Party for such purpose, for that purpose the Holder and the Responsible Party will be subject the procedures establish in the Chapter IV of “Del Ejercicio de los Derechos de Acceso, rectificación, Cancelación y Oposición” articles 28 to 35 of the Ley Federal de Protección de Datos Personales en Posesión de los Particulares, its rules and regulations and its amendments from time to time.

 

TRANSFER OF DATA

 

The Holder consents to the transfer of data within and outside the country to third persons or entities or foreign, that provide the necessary services Responsible Party for proper operation, when having made ​​available the notice of privacy, does not oppose.

 

In relation to the provisions of paragraph I of Article 10 of the Ley Federal de Protección de Datos Personales en Posesión de los Particulares, the Responsible Party is authorized to transmit the data of the Holder to any municipal, state or federal authority as required.

The Responsible Party reserves the right to make changes at any time or update this privacy notice, always in compliance with legislative reforms, internal policies or new requirements for the provision or offer of services or products.

 

The above changes will be disclose to the Holder by any means which the Responsible Party deems appropriate including, without limiting: visible notices in the Responsible Party branches and offices, in widely circulating newspapers,  through email notice.

 

Holder´S CONSENT

The Holder, allow that all personal information, including that with sensitive, financial or equity aspects, to be transferred and use under the terms provided in this privacy notice.

LETTER OF RIGHTS

 

  1. To receive, regarding the offered real estate properties, truthful, clear, and updated information and advertising, regardless of the means of communication, including digital media, in such a way that allows the consumer to make the best purchasing decision by knowing the true characteristics of the property being acquired, in accordance with the Law.
  2. To know the information about the characteristics of the property, including: land area, built surface, type of structure, facilities, finishes, accessories, parking space, common areas, services available, and the general physical condition of the property.
  3. To freely choose the property that best satisfies their needs and fits their purchasing capacity.
  4. Not to make any payment until the contractual relationship is in writing, except for advances and operating expenses, as provided by the LFPC.
  5. To sign an adherence contract under the model registered with the Federal Consumer Protection Agency, containing the terms and conditions of the property purchase. After signing, the supplier is obligated to deliver a copy of the signed contract to the consumer.
  6. To acquire a property that meets the safety and quality characteristics contained in the applicable regulations and reflected in the information and advertising received.
  7. To receive the real estate property within the agreed timeframe and conditions with the supplier in the respective adherence contract.
  8. If applicable, to exercise the guarantees on real estate provided for in the LFPC, considering the specifications provided in the respective adherence contract.
  9. To receive the corresponding bonus or compensation in terms of the LFPC, in case defects or failures in the property persist after the guarantee has been exercised. Likewise, to have the necessary repairs carried out in case of defects or failures attributable to the supplier, or to opt for the replacement of the property or rescission of the contract when applicable.
  10. To have free and accessible channels and mechanisms for inquiries, requests, complaints, and suggestions to the supplier, and to know the address indicated by the supplier for receiving notifications.
  11. Right to protection by the competent authorities and in accordance with applicable laws, including the right to file complaints and claims with them.
  12. To have a Privacy Notice available to understand the treatment that will be given to the personal data provided and consent to it, if applicable; for their personal data to be treated in accordance with applicable regulations, and to know the available mechanisms to exercise their Rights of Access, Rectification, Cancellation, and Opposition.
